Contentious probate refers to any dispute about the administration of a deceased person’s estate. These issues often involve:

  • Disagreements over the validity of a will

  • Concerns about mental capacity or undue influence

  • Claims by individuals who believe they should have received financial provision

  • Disputes between executors, beneficiaries, or family members

Common Reasons to Challenge a Will

You may be able to contest a will if:

  • The will was not properly signed or witnessed

  • The person lacked mental capacity when the will was made

  • Someone exerted undue pressure on the person making the will

  • There is evidence of fraud or forgery

  • You were financially dependent on the deceased and not adequately provided for

Who Can Contest a Will?

In most cases, those who can bring a claim include:

  • Family members (children, spouses, or cohabitees)

  • Beneficiaries named in a previous will

  • Those who were financially dependent on the deceased

  • Executors or administrators in dispute over their role

Time Limits for Inheritance Disputes

Strict deadlines apply to different types of claims. For example:

  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975 must usually be made within 6 months of the Grant of Probate

  • Disputes about the validity of a will should be raised as early as possible, preferably before probate is granted
